AGREEMENT TO TERMS

  • “You”: The person or consumer using our services for booking or any purpose through us.
SECTION 1: RULES AND RESTRICTIONS
 

Along with these terms and conditions, your booking is subject to the specific terms and conditions of the travel providers you choose, which we call “Rules and Restrictions.” These might include payment rules, refund policies, penalties, and usage limitations.

When you book with Faresflightqube , you agree to follow both our terms and the rules and restrictions of the third parties you’ve selected. We’ll show you these rules before you complete your booking, and they are considered part of our terms.

Failure to comply with travel provider rules may result in:

  • Cancellation of your booking
  • Denial of access to travel services
  • Loss of any money already paid
  • Payment for costs incurred by Faresflightqube  or travel providers due to non-compliance
Free Cancellation Policy
 

United States: For tickets purchased in the United States, you may cancel your booking without penalty within 24 hours of purchase, provided the flight departure is at least 7 days (168 hours) away when you book.

Canada: For tickets purchased in Canada, you may cancel without penalty until 11:59 PM EST on the day you made the booking, regardless of departure date.

SECTION 2: USING OUR WEBSITE
Purpose and Authorized Usage

Fareflightqube  provides you access to our online platform and services to help you find information about different travel services and make bookings. You may only use our services for personal, non-commercial purposes.

By using this site, you confirm that:

  • You are at least 18 years old and legally able to make contracts
  • You will use our services according to these terms and all applicable laws
  • All information you provide to us is accurate, current, and complete
  • You are responsible for maintaining the confidentiality of your account credentials
  • If booking for others, you have their permission and will inform them of all rules and restrictions
Prohibited Activities

You agree NOT to:

  • Make false or fraudulent bookings
  • Use automated tools (robots, scrapers) without our permission
  • Attempt to bypass security or interfere with our services
  • Place unreasonable load on our systems
  • Deep link or frame any part of our services without written permission
Account Management

To create an account, you must be at least 18 years old and follow all instructions on our services. Your Faresflightqube account may provide access to other related platforms or services we operate. When using those, their specific terms and conditions will apply. You may delete your account by following the account deletion process on our services. See our Privacy Policy for more information about your rights.

SECTION 3: BOOKING CONFIRMATION

Once you complete a booking with us, we’ll send you a confirmation email to the address you provided. This email will contain all important details about your booking and prices. If you don’t receive the confirmation within 24 hours, please contact us immediately.

After payment, it’s your right to receive a confirmation email with all necessary information about your reservation. We never delay sending such emails; any delay may be due to a technical issue which will be resolved quickly.

SECTION 4: PAYMENT TERMS

Pricing

The price of travel services will be as shown on our services unless there is an obvious mistake. Prices may change, but changes made after you confirm your booking usually won’t affect your existing booking. If we find a clear pricing error, we may give you the option to proceed with the correct price or cancel your booking without penalty.

Taxes

Prices shown may include taxes or tax recovery charges, calculated based on the service price before discounts unless a reduction is relevant for tax reasons. Our role in collecting and paying taxes varies by location. You may need to pay certain local taxes (city or tourist taxes) collected by us or third parties. We’ll inform you of any local taxes before you complete your booking if we have that information.

Payment Processing

For some travel services like packages, payment may be collected in separate transactions and could appear as charges from multiple companies on your statement. The total amount will not exceed the total price of your booking.

Our Privacy Statement details how we handle your payment and account information, especially if you save a credit or debit card for future use.

Payment Authorization

By using our services, you authorize us to:

  • Verify your payment method through pre-authorization or other verification methods
  • Charge your payment method for the booking amount once verified
  • Process payments directly with relevant service providers for your approved travel plans
  • Share your information with third parties involved in your travel arrangements
Bank and Card Fees

Your bank or card company may charge additional fees for international transactions, currency conversion, or cross-border fees. If your booking currency differs from your card currency, your card company may convert the amount and charge a fee. Contact your bank for questions about these fees or exchange rates, as Faresflightqube is not responsible for any exchange rate changes or fees from your card company.

Fraud Prevention

If a reservation or account appears potentially fraudulent or linked to sanctioned persons or companies, we may request additional information. If we still suspect suspicious behavior, we may:

  • Cancel any bookings made under your name, email, or account
  • Close any related accounts
  • Take legal action, including seeking reimbursement for losses

If you believe your booking was cancelled or account closed by mistake, please contact us for assistance.

SECTION 5: CANCELLATION AND CHANGES

Cancellation and change policies vary by travel provider and fare type. Please review the specific rules and restrictions for your booking before confirming. Changes or cancellations may incur fees set by the travel provider.

Service fees charged by Faresflightqube  are generally non-refundable unless otherwise stated. For detailed cancellation policies, please refer to our Cancellation Policy page.

You are responsible for ensuring you have valid travel documents (passport, visa, etc.). Problems arising from missing or invalid documents are your responsibility. You must also follow airline check-in requirements and arrive at the airport on time. Failure to do so may result in denied boarding at your expense.

SECTION 6: USER RESPONSIBILITIES

You confirm that you have reviewed all trip details and that they are correct. Changes made after approval may incur additional fees.

You understand that we are a travel agency, not a direct supplier. Dissatisfaction with supplier services is not grounds for payment cancellation.

You agree to follow all payment deadlines for your reservation. Late payments may result in loss of deposit and booking cancellation.

You are an authorized user of the payment method and agree not to dispute valid charges with your credit card company.

SECTION 7: LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIRSFLY FARE AND Sea And Sky Travel Solutions Private Limited SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

We act solely as an intermediary between you and travel providers. We are not responsible for the acts, errors, omissions, representations, warranties, breaches, or negligence of any travel providers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.

We have no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure, or other causes beyond our direct control.

SECTION 8: INTELLECTUAL PROPERTY

All content on our website, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of Faresflightqube  or its content suppliers and is protected by international copyright laws. The compilation of all content on this site is our exclusive property.

You may not reproduce, modify, copy, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any information or content obtained from our services without our express written permission.

SECTION 9: PRIVACY AND DATA PROTECTION

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

We may share your personal information with travel providers and third parties involved in fulfilling your travel arrangements. We are not responsible for how these third parties use your personal information after we provide it to them for your travel services.

SECTION 10: INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Faresflightqube , Sea And Sky Travel Solutions Private Limited, and our affiliates, officers, directors, employees, agents, and suppliers from and against any claims, actions, demands, liabilities, and settlements, including without limitation, reasonable legal and accounting fees, resulting from or alleged to result from your violation of these Terms or your use of our services.

SECTION 11: THIRD-PARTY LINKS AND SERVICES

Our services may contain links to third-party websites or services that are not owned or controlled by Faresflightqube. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that Faresflightqube 

shall not be responsible or liable for any damage or loss caused by your use of any such third-party websites or services.

SECTION 12: MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by posting the new Terms on this page and updating the “Last Updated” date at the top of these Terms.

Your continued use of our services after any changes indicates your acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes.

SECTION 13: SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced with a valid provision that comes closest to the intent of the original provision.

SECTION 14: GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Brooklyn, New York.

Any disputes arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in Tarrant County, Texas.

SECTION 15: DISPUTE RESOLUTION AND ARBITRATION

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Brooklyn, New York, before one arbitrator.

The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. Judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver:

YOU AND AIRSFLY FARE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You agree that any arbitration will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Exception: Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim is within the court’s jurisdiction.

Electronic Signature Agreement

 

By using our services and submitting any agreement electronically, you are signing it as an individual. You acknowledge that we may take legal action to enforce this contract if you fail to honor the fees you’ve agreed to. In such cases, you agree to be responsible for all applicable cancellation fees, legal costs, and expenses we incur.
